PREPAID OPPORTUNITIES AND CHALLENGES IN POLICY AND REGULATION
Government can be a two edged sword – some regulations are making prepaid more attractive relative to other products, others serve to even the playing field and make all players do what the best companies are already doing. Some regulations drive unintended consequences. As with all financial services, the prepaid card industry is getting it's share of legal and regulatory challenges at both the state and federal levels. A number of areas are impacting prepaid including: oversight from FinCEN, the Consumer Financial Protection Bureau, the interpretation of the Durbin Amendment’s treatment of prepaid cards, and the extension of Reg E.
