New TPCA decisions by Federal Courts are threatening the FCC’s 2008 “express consent” interpretation for creditors and collection agencies. Court are also challenging Preview Dialing which has been used as a work-around to avoid the expansive interpretation by the FCC of what is a “dialer” under the TCPA. Courts are also challenging the FCC’s right to interpret the TCPA and the terms therein. With the law in complete flux, how can companies navigate the TCPA waters, comply with the law, and still conduct their business?
