The CFPB and Debt Collector Oversight

Created in July 2010 by the Dodd-Frank Wall Street Reform and Consumer Protection Act, the Consumer Financial Protection Bureau (“CFPB”) has broad authority to implement and enforce federal consumer protection laws, including the Fair Debt Collection Practices Act and the Fair Credit Reporting Act. The CFPB is also tasked with preventing unfair, deceptive, or abusive acts or practices in connection with any transaction with a consumer for a consumer financial product of service.

This Webinar will first provide an overview of the structure and authority of the CFPB. We will then focus on the CFPB’s oversight of the debt collection industry, including analyzing the CFPB’s final rule defining “larger participants” of the consumer debt collection market, which became effective on January 2, 2013 and empowers the CFPB to conduct examinations of larger participants in the consumer debt collection market. The Webinar will then consider what those examinations may entail, as well as other legal and logistical issues posed by the CFPB’s oversight of debt collectors.
