Approximately 445 collection companies and creditors were named in lawsuits citing violations of the Fair Debt Collection Practices Act (FDCPA) and other consumer rights statutes during the first two weeks of this month, according to WebRecon LLC, a Grand Rapids, Mich.-based firm that publishes "The FDCPA Litigant Alert."
During the period, 430 unique plaintiffs filed 346 FDCPA lawsuits and another 39 Fair Credit Reporting Act (FCRA) lawsuits. There were multiple plaintiffs involved in one case. Eighty-two plaintiffs previously sued under consumer statutes. Combined, those plaintiffs have filed an estimated 555 lawsuits since 2001. Illinois' Northern District Court (Chicago) led the way with 40 lawsuits, followed by California's Central District Court (Los Angeles) with 32.
Year-to-date, 6,376 FDCPA, FCRA or TCPA (Telephone Consumer Protection Act) lawsuits have been filed in the U.S. – including 5,488 citing FDCPA violations, 875 involving the FCRA and 13 citing the TCPA, according to WebRecon.
