Serverside Group Ltd. on Nov. 30 announced a settlement in a patent-infringement lawsuit Quark Images LLC brought earlier this year against the maker of payment card-customization systems and several of its financial-services customers.
The London-based firm was among more than 25 other defendants in the suit filed Aug. 12 in U.S. District Court for the Eastern District of Texas. Terms of the settlement were not disclosed.
In its complaint, Longview, Texas-based Quark alleged patent infringement regarding the “method and apparatus” for creating and ordering branded merchandise over a computer network. Co-defendants included several national marketers of custom-designed products and merchandise, including Nike Inc., Hallmark Cards Inc. and Ralph Lauren Media LLC.
The litigation stemmed from Seattle-based Jones Soda Co.’s announcement last year of its intention to “explore” potential licensing arrangements with third parties to commercialize its own customized soda label-manufacturing processes.
Serverside clients covered in the settlement include America First Federal Credit Union, BBVA Compass Bancshares Inc., BMW Financial Services N.A., Capital One Financial Corp., CardLab Inc., Shoreline Business Solutions Inc., Wescom Credit Union and Zions Bancorp.
“Serverside is committed to a robust intellectual-property position,” Michael Campbell, Serverside general counsel, said in a statement. “We are delighted to have quickly resolved the matter on behalf of our present and future clients.”
Founded in 2003, Serverside in April formed a partnership with Total System Services Inc. to provide customized payment cards on demand through the TSYS Card Shop (see story).
